An AkwaIbom State High Court has sentenced Pastor Godwin Moffat (pictured above), a former NDDC Commissioner representing Akwa Ibom State, to three years imprisonment for stealing 56 transformers worth N220, 176, 320 which was  meant for oil producing communities in the state.

In a 56 count charge filed in court by the EFCC, Pastor Moffat was said to have applied for 90 electricity transformers and 4 generators from NDDC for Akwa Ibom State sometime in February, 2006. Approval was given for 70 transformers but he diverted same to his house in Eket on the pretext that there was no space to accommodate the newly issued 70 units of transformers at the NDDC office in Uyo.

He thereafter sent only 14 Units to NDDC office in Uyo while he withheld 56 units which he could not account for till date.

One of the count reads,

“That you Pastor Godwin Moffat Eyo being a former Akwa Ibom State representative on the Board of the Niger Delta Development Commission (NDDC) on or about 14thApril, 2006 at Uyo in the Uyo Judicial Division did fraudulently steal a 300 KVA/33/0.415 Transformer Serial No. 1712496 valued at Four Million, Eighteen Thousand, Five Hundred and Sixty  Naira (N4,018,560.00), property of NDDC and thereby committed an offence of stealing contrary to Section 399 and punishable under Section 404 of the Criminal Code Cap. 38, Volume 2, Laws of Akwa Ibom State, 2000”.

The rally cry by the Governor of Ekiti State Ayo Fayose to citizens of the state in a bid to tilt the advantage to his side in the continuing feud with the House of Assembly has caused divisions in the labor sector as some workers in the state are said to be unhappy with labour leaders who have allegedly abandoned their primary duties of agitating for their welfare and instead chosen to dabble in politics.

Acting under the aegis of Ekiti Enlightened Workers’ Forum, EEWF, the workers slammed the Nigeria Labour Congress (NLC),the Trade Union Congress (TUC) and Joint Negotiating Council (JNC) for their role in locking 19 All Progressives Congress lawmakers out of the state.
The workers noted that it was wrong for labor to have joined hoodlums in blocking roads and causing statewide panic claiming that labor leaders were pursuing personal gains.
They wondered if labour had become an branch of the Peoples Democratic Party (PDP) in Ekiti State, saying the issue of workers’ welfare rather than taking sides with political gladiators should concern the unionists.
The workers urged the union leaders to steer clear of politics, especially the raging impeachment crisis and face their welfare, which they said has affected their morale.
Also, the interests of workers, they claimed, should be the topmost priority of their leaders and this must not be traded on the altar of politics which they believed labour leaders have turned into a lucrative business venture when civil servants and other workers are wallowing in poverty.
The EEWF further stated that it was callous of NLC, TUC and JNC leaders to fight an unnecessary political war when the labour force have not been paid salaries since September, maintaining that the government has since received September allocation, hence payment should not be delayed.
Other demands of the aggrieved workers include payment of 2014 leave bonus, remittance of various deductions, such as cooperative, check-off dues and loans to banks made from workers’ July to September 2014 salaries.
“It should be stressed that workers rely on ‘sharp-sharp’ loans and rather for the leadership of Labour to demand for improved welfare, the so-called labour leaders are conniving with the government to introduce another form of ‘sharp-sharp’ loans to workers.
The burden resulting from interests on these loans is too hard for workers to bear! Government is a continuum, as soon as a government is sworn in, such government acquires assets and liabilities of the previous administration.
The above matters are issues which the leadership of labour is expected to pursue but the so-called self-imposed/anointed leaders in NLC, TUC and JNC have vowed not to pursue because of their personal gains.
At any rate, our present state of labour ineptitude may remain with us for a long time to come, unless the good workers of this state take some drastic steps to stem this unfortunate tide,” they said.

Why I Refused To Sign Amended 1999 Constitution – Jonathan

Why I Refused To Sign Amended 1999 Constitution – Jonathan

04:45 Add Comment
image
President Goodluck Jonathan has refused to sign the constitution amendment bill forwarded to him by the National Assembly but he has 13 reasons for not doing so.

Among other things the amendment had approved life pension for anybody who has ever held the officeof President or Vice President, Senate President or Deputy Senate President, Speaker or Deputy Speaker of the House of Representatives.
In a letter entitled: “Re: Constitution of the Federal Republic of Nigeria, Fourth Alteration Act, 2015,” Jonathan questioned the power the National Assembly to arrogate to itself the power to pass any constitution amended without the assent of the President as contained in the amendment.
The president also disagreed with the way the power of the President had been whittled down. He said thatthe two chambers of the National Assembly failed to meet requirements for altering Section 9 (3) of the 1999 Constitution.
“Section 4 of the Fourth Alteration Act, 2015 seeks to alter Section 9 of the 1999 Constitution by the insertion of a new subsection 3A, which dispenses with the assent of the President in the process of constitution amendment.
However, this alteration can only be valid if the proposal was supported by votes of not less than four-fifths majority of all the members of each House of the National Assembly and approved by a resolution of the Houses of Assembly of not less than two-thirds of all the states as provided by Section 9 (3) of the 1999 Constitution.“
This is a fundamental requirement of the constitution and in the absence of credible evidence that this requirement of the constitution was met in the votes and proceedings of the National Assembly, it will be unconstitutional for me to assent to this Bill,” he explained.
The President also said there were a number of provisions in the Act that altogether constitute flagrant violations of the doctrine of separation of powers enshrined in the 1999 Constitution and unjustifiably whittle down the executive powers of the federation vested in the president by virtue of Section 5 (1) of the 1999 Constitution.
Jonathan observed that the power vested in the President to withhold his assent to bills passed by the National Assembly was part of checks and balances contained in the constitution.
He said Sub-section 5a of Section 58,which provides that the bill becomes law after the expiration of 30 days in the event that the president fails to signify the withholding of his assent, may be inappropriate.
“The provision appears not to have taken cognizance of the aforementioned variables, the vagaries inherent in the legislative process and the wisdom in requiring two-thirds majority to override the President’s veto.
In the light of the above, I am of the view that the failure to signify assent by the President within the prescribed period of 30 days should rather be treated as dissent, which would require two-thirds majority to override.”
Jonathan also faulted the National Assembly over its alteration, seeking to limit the period when expenditure can be authorized in default of appropriation from the six months provided in the constitution to three months.
“I am of the view that this provision has the potential of occasioning financial hardships and unintended shut-down of government business, particularly where for unforeseen reasons and other exigencies in the polity, the National Assembly is unable to pass the Appropriation Act timeously.
“Our recent experiences with the process of passing the AppropriationAct do not justify the reduction of six-month time limit in the constitution,” he insisted.
The President also faulted Section 84a that created the new Office of Accountant General of the Federation distinct from the Accountant General of the Federal Government, saying it did not address the funding requirements for establishment of the office.
“It is necessary to clarify, for instance, who staffs and funds the office of Accountant-General of the Federation and from whose budget he will be paid since he serves the three tiers of government,” he stressed.
The President equally faulted the National Assembly in separating the Office of the Attorney General of the Federation from the Minister of Justice and the Attorney General from the Commissioner for Justice inthe respective states of the federation and also the provision for independence of the Office of Attorney General by guaranteeing tenure and funding.
He said as desirable as the alterations were, there were some provisions that violate the doctrine ofseparation of powers and also negate what he called “the age-long independence and absolute discretion that the office has enjoyed for centuries since its creation in the middle ages.”
He said the first setback was that thealteration was silent on who was the Chief Law Officer of the Federation, noting: “This is a serious lacuna, which may create implementation challenges.”The National Assembly Conference Committee was shocked by the president’s letter, to say the least.
The committee comprise members of the Constitution Review Committee in both the Senate and the House of Representatives, which yesterday, began a two-day retreat to look into the bill and the consequence of the president’s action. Its position on the development is expected next week.
Meanwhile, Senate President David Mark yesterday stopped members from debating Jonathan’s letter after it was read on the floor of the Senate during plenary yesterday.Shortly after the Senate President finished reading the letter, Senator Abubakar Yar’Adua, APC, Katsina Central, raised a Point of Order, seeking that the Senate be allowed to debate the President’s letter.
“I think it is important for us to discuss that letter and see whether there is need for us to consider the letter or not. I think he has raised very serious fundamental issues, especially in terms of our conscienceas lawmakers and his own position as the chief executive officer of the Federal Republic of Nigeria. That is why I am raising this point or order,” he pointed out. But Mark declined.
“Obviously, this letter is not like any other normal letter. We can’t discuss the letter unless you have a copy of it. So, the first reaction is for me to make copies available to everybody.
And you go and study it. And if you notice, there is an announcement also by the Constitution Review Committee that they are going to meet. So, that will straight away go tothem. I agree with you that weighty issues have been raised. It’s a peculiar case, so everybody will be involved.”

Burna-Boy-2015-Look
Burna Boy has just taken things to the next level by signing a new deal with global brand Island Records, a subsidiary of Universal Music Group.

The talented Reggae/Dance-Hall act took to Social Media to make the announcement moments ago and made the bold veclaim of being the first contemporary Nigerian act to OFFICIALLY sign a deal with the power brand.
The former Aristokrat Records front-runner had been independent since he parted ways with the label sometime last year.
This is surely a step in the right direction for an artiste who’s possibly one of the most underrated names in the game.
He should be clearing out all the major awards yearly.

After a hugely successful first season, it seems the brains behind hit TV series, Empire and one of its lead actors, Terrence Howard, have come against troubled waters as they are now facing a billion dollar law suit.

According to a report by TMZ, Ron Newt, a friend to the Jackson family, is suing the makers of Empire for a billion dollars claiming that the show is a carbon copy of a documentary he did about his life as a gangster and drug peddler.
He alleged that he met with Terrence Howard some time ago and they talked about the documentary which was titled Bigger than Big.” Terrence was said to have developed keen interest in the idea and even offered to play the role of Ron in the flick.
ron newtRon Newt and his documentary
Ron stated certain similarities between his movie and Empire pertaining to the characters. In Empire, Cookie Lyon goes to prison while in Ron’s movie, the character China Doll also goes to prison. Luscious Lyon kills his best friend Bunkie, while in Bigger than Big, the lead character Prince also kills his best friend.
Ron Newt may appear relatively unknown on the music business but according to TMZ, the self acclaimed“known ghetto player” says in 1989, he signed a multi-million dollar deal with Michael Jackson and Death Row Records.
